- You are purchasing the item(s) on your own behalf and not on behalf someone else in order to avoid complying with these Terms and Conditions;

- You assume all risk of use (or misuse) of the item(s) purchased;

You understand that body armor is not bullet proof—IT IS ONLY BULLET RESISTANT, and if a bullet strikes you there is always a risk you will be injured or killed ; and

- You are smart enough to know better than to test body armor by wearing it and being shot with a firearm--any video submitted to us showing such behavior will not be promoted in any way, and, if posted publicly (e.g., YouTube), could be used against you in criminal prosecution; and

- You agree, for yourself and your heirs, assigns, and agents, to fully and completely release, never bring any action in any court of law against, and to indemnify, defend, and hold harmless Battalion Defense for any and all liability stemming from your purchase, possession, or use of the item(s).

Illegally purchasing, possessing, or using body armor or other items sold by Battalion Defense may result in severe legal consequences for you, up to and including incarceration. Battalion Defense will fully cooperate with all criminal investigations. Non-law enforcement residents of Connecticut are prohibited from purchasing body armor.

Battalion Defense assumes NO LIABILITY for your use or misuse of any item(s) sold or donated, including without limitation any incidental or consequential liability. NO ORAL AGREEMENT OR WARRANTY OF ANY KIND SHALL BE BINDING UNLESS IN WRITING AND SIGNED BY Battalion Defense. International Traffic in Arms Regulations (ITAR) / Export Regulations

Level III and IV rifle rated body armor (Rifle Plates) fall under the jurisdiction of the International Traffic in Arms Regulations (ITAR), and are subject to the export control laws of the U.S. Government. Export or retransfer of Rifle Plates by any means to any foreign end user, or for any other end use, whether in the U.S. or abroad, without the written approval of the U.S. Department of State, is prohibited.

The sale, transfer, transportation, or shipment outside of the U.S. of any product prohibited or restricted for export without complying with U.S. export control laws and regulations, including proper export licensing, documentation or authorization, is strictly prohibited and may result in civil penalties and/or constitute a federal crime. Battalion Defense will not engage in any transaction that requires the illegal export of any products and will not assist directly or indirectly with the illegal export or re-export of any products.

It is against Federal Law for a person convicted of a violent felony to purchase or possess body armor. In addition, various States also have laws restricting the purchase or possession of body armor by persons convicted of drug crimes, certain felonies, or other crimes of violence. By purchasing body armor from Battalion Defense you acknowledge and certify that: (1) you have no felony convictions, (2) you have not been convicted of any other crime that would restrict your ability to purchase or possess body armor under any State or Federal law, (3) you do not intend to use the body armor for any criminal purpose and (4) you are over 18 years old. Battalion Defense reserves the right, in its sole discretion, to refuse to sell body armor to any person. Additionally, the sale of body armor to residents of Connecticut is restricted to in-person sales, unless the sale is made to certain law enforcement or military personnel.

We Sell ONLY to Law-Abiding Adults

Body Armor is a purely defensive item but, regardless, we are very sensitive to the possibility of vests being misused by criminals. By buying a vest from us, you certify that you are law-abiding, of adult age, and have no felony convictions. We do not sell to felons or minors, and it is against the law for a felon to possess Body Armor under both federal law (unless required by your employer, see, Sec.931) and is also illegal under state law in many states.
We cooperate with law enforcement to stop the use of vests by criminals. Our cooperation with law enforcement negates our privacy policy.

We reserve the right to refuse to sell to anyone, in our sole discretion. By buying body armor you guarantee that you are not legally prohibited from owning firearms, or body armor, and also that you are not associated with any criminal group, in any way, and have only a lawful purpose for owning body armor.

Level III and IV armor (Rifle Plates) fall under the jurisdiction of the International Traffic in Arms Regulations (ITAR), and is subject to the export control laws of the U.S. Government.Export or retransfer of Rifle Plates by any means to any foreign end user, or for any other end use, whether in the U.S. or abroad, without the written approval of the U.S. Department of State, is prohibited.

There is often an exemption for a U.S. person taking their personal protection with them in their luggage, and returning the armor to the US. For the requirements, click here. One of the forms required may be found here.

Level III-A, Level II, and Level II-A VESTS often have an export license exemption for many countries, but require a license to some countries from the Bureau of Industry & Security (BIS). Kevlar Helmets in quantity, Ballistic Shields, Riot Shields, Face shields and other sensitive items generally require an export license from the BIS.

Residents of Connecticut:

Are prohibited from buying Body Armor unless the sale is face to face (or unless the buyer is a police officer, Police Department, or Military). We cannot ship to residents of Connecticut who are not police or military.

Residents of Alberta, British Columbia, Manitoba:

We will ask you to provide us documentation of your exemption status, or your Body Armor license before purchasing.

NO Armor is 100% Bulletproof

A ‘bulletproof’ vest or other armor will protect you from the vast majority of pistol ballistic threats you are ever likely to face. But there is always a tradeoff between more protection and more wearability (and the constraint to stay within your budget). Please know that:

    • rifle rounds
    • unusual high velocity pistol ammunition
    • pistol ammo fired from a rifle barrel
    • armor piercing ammunition
    • sharp-edged or pointed instruments (e.g., knives, icepicks, etc.), and/or
    • <li">other unusual ammunition or situations…
 CAN Defeat Body Armor.

Also, at some angles projectiles can slide, or deflect off the edges of Armor, or ricochet. Furthermore, projectiles that are successfully stopped by armor will always produce some level of injury, resulting in severe bruising, broken bones, and possibly serious internal injury or even death. Soft body armor defeats most pistol and shotgun projectiles, but NO vest on earth makes you invulnerable to all threats. To state the obvious, getting shot ALWAYS carries some risk.
By buying Armor you assume ALL risks of use or misuse, and agree not to hold us liable in any way. In addition, YOU are responsible to ensure that your ballistic panels are positioned inner side IN, and outer side OUT if applicable (check the inside vest panel label).

Tactical Trauma Release From Liability Waiver, Purchaser’s Release from Liability, Battalion Defense. By purchasing Battalion Defense trauma kits and all products contained therein, the purchaser warrants and attests that they have the necessary training, certifications and/or authorizations to properly deploy and use the kit’s contents and/or accessories. The purchaser also assumes any and all liability for events arising from their use of the kit and will not hold any person or business associated with Battalion Defense nor the company of Battalion Defense, civilly or criminally liable.
